My US based client is seeking an experienced, licensed Paralegal in Ontario to represent them in a single Ontario Small Claims Court action. This specialized assignment focuses on a commercial dispute involving late royalty payments from an Ontario-based reseller.

The successful candidate will act as my clients' representative for the duration of the proceeding, managing all aspects of the small claims process in accordance with Law Society of Ontario (LSO) rules and within the paralegal scope of practice as defined by the Law Society Act and related regulations.

We welcome candidates who thrive in cross-border legal matters, offer outstanding client service, and are committed to achieving favorable results through efficient court proceedings.

  1. Key Responsibilities. Subject to such being consistent with the scope permitted for licensed paralegals under the Law Society Act.
  • Serve as my clients' company representative and primary contact for all communications with the Ontario Small Claims Court for a breach of contract claim.
  • Prepare, file, and prosecute the court action, including all procedural steps: drafting and sending demand letters, issuing and serving court documents, coordinating evidence, and attending settlement conferences and hearings.
  • Act as the company’s address for service in Ontario (solely for this matter and subject to Small Claims Court Rules), ensuring timely correspondence and compliance with court and procedural deadlines.
  • Advise on strategies to maximize claim recovery (excluding any interpretation of U.S. or foreign law), and coordinate efforts to pursue payment from the Ontario-based defendant.
  • Handle service of process on Ontario parties and address any cross-border issues involving a non-resident (U.S.-based, Delaware-incorporated) plaintiff (in compliance with Ontario Rules of Civil Procedure and LSO regulations; no foreign law advice).
  • Assist in evidence gathering and ensure all documentation meets Ontario evidentiary and procedural requirements.
  • Draft a written retainer agreement that meets all Law Society of Ontario rules, including client identification and verification for a foreign corporate client.
  • Provide clear, regular updates on case status, timelines, and procedural developments.

Required Credentials and Relevant Experience

  • Active LSO paralegal license in good standing, authorized to appear before the Ontario Small Claims Court.
  • Track record of managing breach of contract or commercial disputes, with a preference for experience serving international or out-of-province clients.
  • Familiarity with cross-border legal issues in small claims litigation, including service of process, evidence handling, and post-judgment enforcement for non-resident corporate plaintiffs.
  • Ability to draft, review, and execute compliant written retainer agreements, and to support all required client verification steps under LSO regulations for foreign clients.
  • Proven organizational skills to manage all facets of the small claims timeline, communicate clearly, and represent commercial clients effectively in court proceedings.

Preferred Attributes and Additional Assets

  • Demonstrated success recovering debts, enforcing contracts, or achieving settlements for international business clients in Ontario.
  • Up-to-date knowledge of Ontario Small Claims Court procedures, local rules, and best practices for efficient claim resolution.
  • Willingness to work on contingency basis (percentage of recovery) is strongly preferred; hourly or flat rate proposals will also be considered.
  • Exceptional communication and client service orientation, with the ability to explain Canadian legal nuances to non-resident executives.
  • Tech-savvy approach—familiarity with e-filing, online case management, and secure document exchange.

Engagement Details and Requirements

  • Engagement limited solely to the Ontario Small Claims Court action identified; no ongoing paralegal-client relationship beyond the matter in question.
  • Flexible, project-based contract immediate start expected, and anticipated to last through to December 31, 2025, with potential for remote work and asynchronous collaboration.
  • Compensation to be negotiated—please indicate your preferred structure (contingency, hourly, or flat fee) and applicable rates.

To apply: Submit your resume/CV, evidence of LSO licensure in good standing, a brief summary of your experience in Ontario Small Claims Court for international/commercial clients, your proposed compensation structure, and availability for the designated period.
