Essential Functions:
Directly handles the most complex extra contractual claims and/or complex coverage claims in multiple lines of business
Properly reviews, analyzes exposures, and assesses the overall potential of recovery in disputed matters and litigated files
Analyzes coverage, determines liability, and extent of damages
Obtains favorable resolution of claims and lawsuits through careful investigation, evaluation, and effective negotiation
Communicates and collaborates concerning claim recommendations and litigation strategy with appropriate claims team members
In collaboration with outside counsel, develops strategies for the defense and resolution of litigated claims
Prepares reports for errors and omissions (E&O) carriers in appropriate cases
Serves as the highest subject matter expert and provides legal advice and legal review to the company’s Claims departments
Tracks emerging issues that may create exposure for the company or its policyholders
Provides review and advice on pending and potential claims, especially those that could potentially result in extra-contractual liability
Provides advice to claims teams on complex coverage issues and reviews claims as assigned
Prepares training presentations for claim professionals addressing various policy forms and endorsements, focusing on areas of specialized expertise
Serves as Claims Legal liaison to other departments across EMC as the Claims Legal expert
Ensures assigned programs align with overall goals and collaborates with other stakeholders to achieve desired outcomes
Provides project results and feedback on appropriate changes to Coverage Counsel team members on their assignments
Collaborates with Underwriting through reviews of proposed policy language and prepares memorandums, researching and discussing potential legal issues raised by proposed forms and endorsements
Identifies issues in existing policy language and form usage and discusses implications with underwriters and Claims (as appropriate)
Education & Experience:
The education and experience below are required for the job unless labelled as preferred:
Juris doctorate (JD)
Bar admission in at least one state
Ten years of experience in property and casualty insurance coverage defense litigation within a law firm or in-house legal team or related experience
Experience in handling extra-contractual matters/litigation
Knowledge, Skills, & Abilities:
Superior knowledge of litigation management
Superior knowledge of the theory and practice of the claim function
Analytical ability and demonstrated experience of good judgment with regard to legal liability and coverage
Excellent knowledge of insurance contracts, medical terminology and legal aspects of court procedures affecting legal liability for all lines of insurance
Excellent knowledge of computers and claims systems
Superior organizational and written and verbal communication skills
Superior investigative and problem-solving abilities
Occasional travel; a valid driver’s license with an acceptable motor vehicle report per company standards required if driving
